DOE Proposes Updates to the DEAR

The Department of Energy has issued a proposed rule that would amend the DOE Acquisition Regulation to remove its contract appeals regulation and out-of-date coverage, conform to the Federal Acquisition Regulation, and update references. Specifically, the proposed rule updates the DEAR to reflect the Civilian Board of Contract Appeals provisions of Section 847 of the National Defense Authorization Act of 2006 (PL 109-163), the Federal Management Regulation, and the establishment of the CBCA within the General Services Administration. Other changes are proposed to DEAR Part 901 through DEAR Part 904, DEAR Part 906 through DEAR Part 909, DEAR Part 911, DEAR Part 914 through DEAR Part 917, and DEAR Part 952. The proposed rule does not alter substantive rights or obligations under current law. A complete list of the affected provisions appears in the regulation table below.
